DO I HAVE TO APPEAR IF YOU REPRESENT ME ON MY SPEEDING TICKET?

   This is a question I get often. Many speeding and traffic tickets can be paid online without anyone needing to appear. While this is not a good idea, it is possible because these citations are infractions. Speeding tickets are infractions as well, up to 15 mph over. Once the speed is charged at 16mph over, the speeding ticket becomes a misdemeanor. Because of this, an appearance is mandatory.

   Many clients are confused by the mandatory appearance language found on their ticket. The ticket will tell you literally at the bottom that you MUST appear in court. The reality is, statute allows us to waive appearance on misdemeanors with the court's agreement. With speeding ticket charges, waiver of appearance has become so customary that it really isn't an issue for your attorney to appear on your behalf. In some cases, a written waiver may be required. I always provide these to my clients to be signed and notarized by them ahead of time, if necessary.
